These Ts&Cs, our Privacy Policy and any other rules or guidelines that are posted onto the Website from time to time (together, the “Terms”) are entered into between “you”, the user, and Blossoming Health Nutrition (“we”, “us”, “our”, “I”).
By viewing and using our website you are considered to agree to these terms without qualification. If you do not agree with any of the terms, you must stop accessing and using the website. I reserve the right to change these terms at any time by notifying users of the existence of the amended terms and conditions through the website. By continuing to access my website, you agree to be bound by the amended terms and conditions.
LICENCE TO USE THE SITE
I hereby grant you a non-exclusive, non-transferable licence to use the Website in accordance with the terms. You acknowledge and agree that I may, at any time at my discretion and without prior notice, alter, amend, interrupt, reschedule, modify, or cease the operation of all or any part or any feature of the website; and the website may not operate on a continuous basis, and may be unavailable from time to time (including for maintenance purposes).

On this website, you will find blog posts, information and other resources about nutrition, lifestyle and natural health. The information provided in this website is for your personal or other non-commercial, educational purposes only.
It is not personalised and is of a general nature only so should not be considered as medical or professional advice and it is not intended to diagnosis, treat, or cure any medical conditions, illness, or sickness. There is no working relationship between us unless you purchase a consultation and agree to work with me directly.

VISITOR RESPONSIBILITIES
Any persons using this website for the purpose of purchasing any services or products offered on it at any time must be at least 18 years of age or accompanied by a parent or legal guardian.
In accessing and/or using the website, you must:
(a) Comply with all applicable laws and you must not use the website for any purpose that is unlawful or in breach of the terms;
(b) Not alter or modify any part of the website;
(c) Not attempt to "hack", decompile, disassemble, or reverse engineer any software deployed in connection with the website. This includes "phishing", “mining”, accessing "hidden" URLs, trying to guess users’ passwords, attempting to trigger remote code for the purpose of accessing data or material you would not otherwise have access to;

(g) Not alter or remove any copyright statement or other notice of ownership of Intellectual Property Rights which accompany the website.
You must take your own precautions to ensure that your process for accessing the website does not expose you to risk of viruses, malicious computer code or other forms of interference which may damage your computer system.
This website is operated by me, from Australia. The information on my website may not be appropriate or available for use in other jurisdictions. If you choose to access my website from a jurisdiction other than Australia, you do so on your own initiative and you are responsible for compliance with any applicable laws of that jurisdiction.
DOWNLOADS
While all care is taken to ensure downloadable documents and content are safe, I am not responsible for any virus or any other damage that might occur as a result of downloading content or materials from the website. It is your responsibility to ensure you have appropriate internet security in place on your device prior to downloading any material.
APPOINTMENT AND BOOKING POLICY
Consultation bookings are made using Simple Clinics booking software. They accept all major credit and debit cards through Square, a third-party payment provider. All card numbers are encrypted and no Square internal servers and daemons can obtain plaintext card numbers. No credit card details are kept on file without your consent.
Full payment (100%) of the consultation fee is required upon booking. No appointment will be confirmed before payment is received. Any supplements or pathology that is recommended during the consult will be an additional cost to you and orders will not be processed until payment is received.
Upon booking, you will receive a confirmation email with a link for a Client Intake Form and a Client Consent Form. Both of these forms must be competed and returned to me at least 24 hours before your scheduled consultation, the appointment cannot go ahead without them. You will also be sent a PDF Food Recall (with instructions) to complete prior to your appointment. Please upload this to your Patient Portal or email back to georgie@blossominghealthnutrition.com at least 24 hours before your consultation.
It is your responsibility to provide me with pathology/blood test results from the last 6 months (or as requested) at least 24 hours before your appointment. If these are not received, they cannot be considered in the treatment plan for that consultation. If you are referred for blood work following your initial consultation, it is your responsibility to book a follow-up consultation to discuss the results.
Any nutritional supplements that are prescribed during a consultation will be sent through Australia Post or courier after your payment has been received.
As bookings are conducted online via Zoom, please ensure you arrive on time, or at least 5 minutes early to your appointment. No additional make-up time will be offered, or refunds provided, for time missed. The Zoom meeting link will be provided to you via email. Please ensure you have the app downloaded if using a mobile phone or tablet prior to the start of the consultation.
When attending an online consultation, it is your responsibility to access the meeting from an appropriate device (such as laptop, tablet or mobile phone) that has camera capabilities. This is so that we can see each other in a transparent manner and to enable me to share resources with you (should you wish to do so) that may be relevant to your treatment. You should be in a quiet place where you will not be overheard or distracted (such as driving). Consultations are conducted in a private and confidential manner. Recording of the consultation is not permitted by either party.
I will endeavour to send you your treatment plan within 3 days of your consultation. If there is any delay to this, I will let you know.
Treatment outcomes cannot be guaranteed. While I will do my best to help you with your health concern, everyone is individual and results may vary from person to person.
CANCELLATION POLICY AND REFUNDS
Your time and mine are valuable. I understand that life happens and unexpected events or illnesses may occur, so if you need to reschedule or cancel your appointment, I request at least 24 hours’ notice before your scheduled appointment time.
If you cancel your appointment, or do not show up for it (without letting me know), then you will forfeit the full cost of your consultation.
If you cancel your appointment outside of the 24-hour window, I will offer a refund, less a 2.2% processing fee and $20 administration fee. Please contact me directly to reschedule an appointment, or this can be done through the Simple Clinics Patient Portal.
I do not tolerate inappropriate behaviour, verbal abuse or aggressive behaviour in any way. If such behaviour does occur, I will terminate the consultation at the time (at my discretion) and you will be charged the full cost of the consultation.
I do not offer refunds for digital products such as ebooks and guides, due to the nature of the product.
During a consult, if my internet or power cuts out, I will attempt to use an alternative internet connection. If this fails, I will attempted to finish the consultation via a phone call, using the contact number provided at time of booking (please ensure this is up to date). If a phone call is unsatisfactory to you, I will reschedule the appointment to a time suitable to both parties for no cost.
If I am unwell and unable to attend a scheduled consultation, I will reschedule the appointment to a time suitable for both parties or a full refund on this occasion. If you are unwell and unable to attend a scheduled consultation please cancel or reschedule your appointment please do so on the Simple Clinics patient portal, the link for the portal can be found in your booking confirmation email.
WARRANTIES
The Website is provided “as is” and “as available”. To the extent permitted by law we do not warrant that the operation of the Website will be secure, confidential, uninterrupted, or error-free and we exclude all representations and warranties (in each case, whether express or implied) in respect of the completeness, accuracy, reliability, suitability, or availability with respect to the Website and the information contained on any part of the Website for any purpose.
To the fullest extent permitted by law, we exclude all liability for any loss or damage that results from your use of our Website, including from all express and implied warranties and representations. We will not be responsible for errors or misstatements or be liable, whether in contract, tort (including negligence) or otherwise, for any loss or damage however caused (including Consequential Loss). If you are a consumer using our Website for non-business activities, then nothing in these terms and conditions is intended to abrogate any rights you might have under Australian Consumer Law (if any).
You agree that if you breach these Terms, or any liabilities are incurred arising out of your use of the Website, you will be responsible for the costs and expenses that we and any of our Associates incur as a result of the breach, including reasonable legal fees (if applicable). You will remain liable if someone else uses your account and/or personal information unless you can prove that such use was fraudulent. You will take all necessary action to defend and indemnify us and our directors, employees and agents against all costs, expenses and damages incurred in connection with any claim brought by a third party against us that arise from a breach by you of any of these terms and conditions.

No part of our Website may be distributed or copied for any commercial purpose, and you are not permitted to incorporate the material or any part of it in any other work or publication (whether in hard copy, electronic or any other form) without our prior written consent. Further, you may not remove or alter any trademarks or logos that appear on any material on our Website. If you wish to share a blog post or other publicly available content, you may do so provided there is a link to this website.

These Terms are governed by and will be construed in accordance with the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of Queensland, Australia.
